PrisTrak Terms of Service

1. Acceptance and Operator

These Terms of Service (the “Terms”) are an agreement between you and Sagrathor L.L.C-FZ, Meydan Grandstand, 6th floor, Meydan Road, Nad Al, Dubai, UAE (“Sagrathor,” “we,” “us,” or “our”). They govern the PrisTrak mobile application, website, and related services (collectively, the “Service”).

By accessing the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service. Mandatory consumer rights in your country remain unaffected.

2. Eligibility and Accounts

You must be at least 16 to use PrisTrak. You must be at least 18 and legally capable of entering a binding agreement to publish a marketplace listing, contact a seller for a proposed transaction, or transact with another user.

You must provide accurate information, safeguard account credentials, and promptly notify support@pristrak.com of suspected unauthorized access. You are responsible for activity under your account except to the extent caused by us.

3. PrisTrak Service

PrisTrak may allow users to submit images to identify antiques and other collectibles, review catalog and comparable-sale information, view estimated-price ranges, organize collections, create and browse item listings, report listings, contact sellers using listed contact information, and access premium features.

Features, supported item categories, usage limits, and availability may change. We may correct data, remove content, and discontinue a feature subject to applicable law and active paid-access obligations.

4. User Content and License

“User Content” means images, item details, collection data, listings, prices, descriptions, identification feedback, reports, and other material you submit. You retain your ownership rights.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt for technical formatting, display, and distribute User Content as necessary to operate, secure, moderate, support, and improve the Service. This license ends when the content is deleted except for lawful retention, material already shared with other users, de-identified data, and backup copies removed through ordinary cycles.

You represent that you have the rights needed to submit User Content and that it is accurate to the best of your knowledge, lawful, and not misleading or infringing. Do not upload images containing people, addresses, documents, or other unnecessary personal information.

5. Identification and Estimated Prices

Identification results and estimated prices are provided for informational purposes only. They are not a professional appraisal, authentication, grading, provenance verification, investment advice, or a guarantee of authenticity, ownership, condition, value, or sale price.

Results may be generated or supported by automated matching, catalog records, user submissions, historical sales, publicly available sources, and marketplace information. An image may be incomplete, ambiguous, altered, or incorrectly matched. Price information may be delayed, incomplete, region-specific, or based on items with different condition, origin, restoration, authenticity, fees, or transaction terms.

Inspect the item, verify ownership and provenance, consult a qualified appraiser or relevant specialist when appropriate, and make your own decision before buying, selling, insuring, financing, exporting, donating, or otherwise relying on a result.

6. Internal Marketplace

PrisTrak provides listing, discovery, reporting, and seller-contact tools. PrisTrak is not a party to any transaction between users. We do not process payments for listed items, hold funds, provide escrow, arrange shipping, take title to items, or guarantee either user's performance.

A listing is an invitation for users to communicate, not a PrisTrak offer or warranty. Users independently decide whether and how to transact and are responsible for identity checks, item inspection, authenticity, lawful ownership, payment method, delivery, insurance, returns, taxes, duties, permits, and disputes. Do not send money or disclose sensitive financial information until you have independently assessed the counterparty and transaction.

Sellers must describe the item and asking price accurately; use current images of the actual item; disclose known damage, restoration, alterations, reproductions, authenticity concerns, ownership restrictions, and other material facts; and promptly remove unavailable listings. Buyers must review the listing, ask questions, and conduct their own due diligence.

7. Prohibited Items and Conduct

You may not use PrisTrak to list, promote, request, or facilitate:

• counterfeit, stolen, fraudulent, unlawfully reproduced, or illegally obtained items;
• unlawfully exported, imported, excavated, or traded cultural property, archaeological material, human remains, or sacred objects;
• items made from protected species or restricted wildlife materials, including ivory, where sale or transport is prohibited;
• weapons, ammunition, explosives, controlled substances, alcohol, tobacco, hazardous materials, recalled goods, or other regulated or dangerous items not expressly permitted by law and PrisTrak;
• content that infringes intellectual-property, privacy, publicity, or other rights;
• false, deceptive, abusive, threatening, hateful, obscene, or harassing content or communications;
• price manipulation, impersonation, phishing, spam, malware, laundering, sanctions evasion, or other fraud;
• scraping, automated extraction, reverse engineering, interference, excessive requests, or attempts to bypass access, subscription, moderation, or security controls.

8. Reports, Moderation, and Intellectual Property Complaints

Use PrisTrak's reporting control or email support@pristrak.com to report a listing, user conduct, safety issue, or suspected rights violation. Include the listing or content location, the reason for the report, and supporting information. Rights complaints should identify the protected work or right, the challenged material, your authority, and a good-faith basis for the request.

We may review, filter, reject, remove, restrict, preserve, or disclose content; limit seller contact; or suspend an account when reasonably necessary to enforce these Terms, respond to reports, protect users, comply with law, or maintain the Service. We do not undertake to monitor every listing and cannot guarantee that objectionable or unlawful content will never appear.

9. Premium Access and Store Purchases

PrisTrak may offer weekly or annual auto-renewing subscriptions, an eligible-user trial, and a one-time non-consumable lifetime purchase through Apple App Store or Google Play. Current prices, billing periods, eligibility, benefits, and renewal terms appear on the purchase screen and in the store confirmation before purchase.

Store purchases are governed by the applicable store terms and our Purchase Terms. Deleting the app or your account does not cancel an active store subscription. Use the store's subscription-management controls to cancel it.

Additional terms for Apple users

These Terms are between you and Sagrathor, not Apple. Sagrathor, not Apple, is solely responsible for PrisTrak and its content, maintenance and support, warranties not effectively disclaimed, and claims relating to the app, including product-liability, regulatory, consumer-protection, and intellectual-property claims. If PrisTrak fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as provided by its rules; to the maximum extent permitted by law, Apple has no other warranty obligation.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism and are not listed on a U.S. Government prohibited or restricted parties list. You must comply with applicable third-party terms when using PrisTrak. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Apple-specific terms against you.

10. Third-Party Services

PrisTrak relies on app stores, cloud hosting, image processing, analytics, crash reporting, notifications, authentication, email, and device services. Third-party links and services are governed by their own terms and privacy practices. We are not responsible for a transaction, message, payment method, delivery provider, app store, or other service selected independently by a user.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment.

We do not warrant that PrisTrak will be uninterrupted, error-free, secure, or complete, or that any identification, estimate, catalog entry, listing, user, item, communication, or third-party service is accurate, authentic, lawful, safe, available, or suitable for your purpose.

12. Limitation of Liability

To the maximum extent permitted by law, Sagrathor and its affiliates, officers, employees, agents, licensors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profit, revenue, data, goodwill, opportunity, or expected value, arising from the Service.

We are not liable for user content, misidentification, an inaccurate estimate, an item defect or counterfeit, a user communication, an off-platform payment, non-delivery, shipping loss, tax, or dispute between users, except where liability cannot lawfully be excluded.

To the maximum extent permitted by law, our aggregate liability arising from the Service will not exceed the greater of the amount you paid for PrisTrak in the 12 months before the claim or USD 100. Mandatory consumer rights and liability that cannot be limited remain unaffected.

13. Indemnification

To the extent permitted by law, you agree to indemnify Sagrathor and its affiliates, officers, employees, and agents from third-party claims and reasonable costs arising from your unlawful User Content, listing, transaction, misuse of the Service, violation of these Terms, or infringement of another person's rights. This obligation does not apply to the extent a claim results from our own conduct.

14. Suspension and Termination

You may stop using PrisTrak and delete your account at any time. We may remove content or suspend or terminate access if reasonably necessary for a Terms violation, fraud, safety or legal risk, nonpayment, service discontinuation, or protection of users or systems. Where appropriate, we will provide notice and an opportunity to appeal by contacting support.

Provisions concerning licenses needed for retained content, payments, disclaimers, liability, indemnification, disputes, and other terms that by nature should survive will remain effective.

15. Governing Law and Disputes

These Terms and related non-contractual obligations are governed by the laws applicable in the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to conflict-of-law rules. Subject to mandatory consumer rights, the competent courts of Dubai, UAE have jurisdiction.

If you reside in a jurisdiction providing non-waivable local consumer protections or dispute forums, those protections and forums remain available to the extent required by law.

16. Changes

We may update these Terms when the Service or legal requirements change. We will post revised Terms, update the date above, and provide additional notice when required. Material changes apply prospectively. Continued use after the effective date constitutes acceptance where permitted by law.
